Withdrawal Policy

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day , on which you, or a third party designated by you, who is not the carrier, took possession of the last item.

To exercise your right of withdrawal, you must inform us (Orchideen-Zentrum Wichmann e.K., Tannholzweg 1-3, 29229 Celle, Lower Saxony, info@orchideen-wichmann.de, telephone: 05141-93720) by means of a clear statement (e.g. a letter sent by post or an email) of your decision to withdraw from this contract. You may use the attached model withdrawal form for this purpose, although this is not mandatory. You may also exercise your right of withdrawal online at www.orchideen-wichmann.de. If you use this online function, we will immediately send you a confirmation of receipt on a durable medium (e.g. by email) containing information on the content of the notice of withdrawal, as well as the date and time of its receipt.

To comply with the withdrawal period, it is sufficient for you to send notification of your intention to exercise your right of withdrawal before the withdrawal period expires.

Consequences of withdrawal

If you withdraw from this contract, we shall refund you for all payments we have received from you, including delivery costs (with the exception of any additional costs arising from your choice of a delivery method other than the cheapest standard delivery offered by us), without undue delay and at the latest within fourteen days of the day on which we receive notification of your withdrawal from this contract. We will use the same means of payment for this refund as you used for the original transaction, unless expressly agreed otherwise with you; under no circumstances will you be charged any fees in connection with this refund. We may withhold the refund until we have received the goods back or until you have provided evidence that you have returned the goods, whichever is the earlier.

You must return or hand over the goods to us without delay and, in any event, no later than fourteen days from the day on which you notify us of your withdrawal from this contract. The deadline is met if you dispatch the goods before the expiry of the fourteen-day period. You shall bear the direct costs of returning the goods. You shall only be liable for any loss in value of the goods if this loss in value is attributable to handling of the goods that goes beyond what is necessary to ascertain their nature, characteristics and functioning.

The right of withdrawal does not apply to the following contracts:

  • Contracts for the supply of goods which are liable to deteriorate rapidly or whose expiry date would be quickly exceeded.

Special notes
If you finance this contract through a loan and subsequently withdraw from it, you will no longer be bound by the loan agreement either, provided that both contracts form an economic unit. This is particularly likely to be the case if we are also your lender or if your lender relies on our involvement for the purposes of financing. If the loan has already been disbursed to us when the withdrawal becomes effective, your lender shall assume our rights and obligations under the financed agreement in relation to you with regard to the legal consequences of the withdrawal or the return of the goods. The latter does not apply if the present contract relates to the acquisition of financial instruments (e.g. securities, foreign exchange or derivatives).

If you wish to avoid a contractual commitment as far as possible, exercise your right of withdrawal and also withdraw from the loan agreement if you are entitled to a right of withdrawal in respect of that agreement as well.
